Canine Essentials Owner-Trained Assistance Dogs Register

Each Public Access Card issued by Canine Essentials Pty. Ltd. has a unique QR Code that will direct the person to this page for verification of the Assistance Dog and Handler.

Section 54A of the DDA 1992 stipulates that a (discriminator) may only ask the person with a disability the following: 1. do you have evidence the animal is an assistance animal (per 9.2 c definition “trained to assist a person with a disability to alleviate the effect of the disability”)  and 2. do you have evidence that the anmimal is trained to meet standards of hygiene and behaviour that are appropriate for an animal in a public place. Canine Essentials encourages ALL assistance animal handlers to challenge questions outside of this and to report the person to HRC.

Canine Essentials Assistance Dogs

Denial of public access of the depicted Assistance Dog or Assistance Dog in Training is legislated under the Commonwealth Disablity Discrimination Act (1992) Equal Opportunity Acts (all states in Australia) and Transport Acts (in some States of Australia). This may leave a business (including government) open to litigation by the dis-Abled Handler.

Assistance Dog Info

Please be advised that Assistance Dog Registers nor Public Access Cards are NOT a requirement in Australia. However Canine Essentials Pty. Ltd. have taken this step of creating this Assistance Dog Register here due to unfortunate minor circumstance whereby some Handlers have placed Canine Essentials Logo Badges on their Dogs made by “Logo Makers” or, purchased off of E-Bay (for example), when they have not received the training by Canine Essentials and are not Clients of Canine Essentials Pty. Ltd.

The Assistance Dogs or Assistance Dogs in Training as identified here meet the Disability Discrimination Act (1992) Section 9, 2(c). In addition, these Dog’s and Handlers (where indicated with Pubic Access “rights”) have been assessed by a Qualified Canine Behaviourist and Certified Professional Dog Trainer (whom specialises in training Assistance Dogs) as meeting the Training Standards and alleviates the symptoms of the Hander’s dis-Ability/ies as defined in the Disability Discrimination Act (1992) Section 54A or (where relevant – Section 81 of the South Australian Dog and Cat Management Act); other Assistance Dogs on this Register have also attained State Government accreditation arising from this training, thus attaining Section 9, 2(a) of the Cwlth Disability Discrimination Act (1992).

Only Dogs depicted here are authorised to wear Canine Essentials Pty. Ltd. Logo and have received Assistance Dog Training by Dr. Geller, Certified Professional Dog Trainer and qualified Canine Behaviourist.

Legislation

 

Under Section 9(2) of the Disability Discrimination Act 1992, an assistance animal is a dog or other animal that is: … trained to assist a person with a disability to alleviate the effect of the disability, and to meet standards of hygiene and behaviour that are appropriate for an animal in a public place.

DISABILITY DISCRIMINATION ACT 1992 – SECT 54A

Assistance animals

(1)  This section applies in relation to a person with a disability who has an assistance animal. Note:  For when a person with a disability has an assistance animal , see subsections 9(2) and (4).

(2)  This Part does not render it unlawful for a person to request or to require that the assistance animal remain under the control of: (a)  the person with the disability; or (b)  another person on behalf of the person with the disability.

(3)  For the purposes of subsection (2), an assistance animal may be under the control of a person even if it is not under the person’s direct physical control.

(4)  This Part does not render it unlawful for a person (the discriminator ) to discriminate against the person with the disability on the ground of the disability, if: (a)  the discriminator reasonably suspects that the assistance animal has an infectious disease; and (b)  the discrimination is reasonably necessary to protect public health or the health of other animals.

(5)  This Part does not render it unlawful for a person to request the person with the disability to produce evidence that: (a)  the animal is an assistance animal; or (b)  the animal is trained to meet standards of hygiene and behaviour that are appropriate for an animal in a public place.

(6)  This Part does not render it unlawful for a person (the discriminator ) to discriminate against the person with the disability on the ground that the person with the disability has the assistance animal, if: (a)  the discriminator requests or requires the person with the disability to produce evidence referred to in subsection (5); and (b)  the person with the disability neither: (i)  produces evidence that the animal is an assistance animal; nor (ii)  produces evidence that the animal is trained to meet standards of hygiene and behaviour that are appropriate for an animal in a public place.

(7)  This Part does not affect the liability of a person for damage to property caused by an assistance animal.

Legislative Compliance Statements

On the completion of a Public Standards Assessment, all Handlers of Canine Essentials Pty. Ltd. received a training statement “the Assistance Dog is trained to assist a person with a disability” by RTO qualified Canine Behaviourist and Certified Professional Dog Trainer (specialist areas: Assistance Dog Training; Complex Skills; Scent Detection) and a statement by a Healthcare Professional (Registered with AHPRA) confirming the Assistance Dog is effectively assisting the Handler (person with a disability) to alleviate the effect of their disability/ies.

Confidentiality

For reasons of confidentiality, Canine Essentials Pty. Ltd. have redacted the Handler’s/Owners’s name to conform with Privacy Laws. Media releases for all Dogs depicted here are held with Canine Essentials Pty. Ltd. All documents are held in confidence with Canine Essentials Pty. Ltd. Assistance Dog status as defined within Section 9.2.a of the Disability Discriminion Act (1992) or other authorised bodies have differing requirements inclusive of assessment requirements/re-assessment requirements dependant on state or organisation. Canine Essentials Pty. Ltd. complies with relevant Privacy Laws related to such matters pertaining to specific issues in relation to these.

Insurance

Canine Essentials Pty. Ltd. is fully insured for Assistance Dog Training and Accreditation through Marsh Pty. Ltd. A more in-depth overview of Canine Essentials Pty. Ltd. insurance may be found [here].

Waiver of Liability

The owner of an Assistance Dog is solely liable for any damage to persons, premises, or facilities including places of public accommodation, public conveyances or transportation services, common carrier of passengers, places of housing accommodations, and places of employment caused by that assistance dog.

An “Individual with a disability”, including but not limited to, the blind, visually impaired, deaf, hard of hearing, or otherwise disabled who uses an Assistance Dog shall keep the dog properly harnessed or Leashed, and a person who is injured by the dog because of an “Individual with a disability”, including but not limited to, the blind, visually impaired, deaf, hard of hearing, or otherwise disabled failure to properly harness or leash the dog is entitled to maintain a cause of action for damages in a court of competent jurisdiction under the same laws applicable to other causes brought for the redress of injuries caused by animals.
